Abstract

The research aims to demonstrate the application of the rule of necessities permitting prohibitions to the provisions of asylum abroad It is considered as fundamental study of the subject, through scientific pauses and careful study, based on legal evidence, and rationality for the base of necessities The research was organized into two chapters. The first chapter defines the rule of necessities that permit prohibitions and refugees. It contains two topics. The first is the concept of the rule of necessities, and the second is the concept of asylum The second chapter: the application of the rule of necessities permitting prohibitions, and it contains three sections. The first is the asylum of a Muslim in a non-Muslim country, the second is the coexistence of the refugee with the infidel community, and the third is the refugee’s benefit from the services of the infidel community The research depended on  the descriptive and inductive method, which is concerned with tracking the scientific material related to the rule of necessities, and applying it to the refugees to know its provisions The research came out with scientific results, the most important of which are It is permissible for a Muslim to seek refuge in any country, unless he finds any other Islamic country that shelters him The obligation of sheltering Muslims is one of the duties of the sufficiency, and it is permissible for a refugee to coexist with the infidels in their schools, universities and banks, all according to necessity. He must abide by their regulations and systems, provided that they do not violate the law of Islam
