Abstract

The study aims to clarify the legal relationship between two ships; towing and towed ships, and the responsibility arising when conducting the contract, as well as clarify the arising cases and the specialized court to hear disputes concerning maritime towage contract.

The importance of the study follows the provisions of responsibility resulting from the towage contract, that the Arab maritime legislation don’t’ concern to organize the maritime towage contract in all its aspects, that the towage contract is a contract that is used daily and takes an important position regarding port security and maritime safety in general.

The research problem focuses on identifying the provisions of responsibility resulting from the towage contract. The problem solution focuses that there are special provisions regarding responsibility arising from the implementation of the towage process inside and outside the ports.

The study adopts a descriptive and analytical approach according to the Yemeni marine law, by describing the legal terms and working to analyze them.

The study concludes with several results, the most important ones are: The towage contract, which is binding on both sides, results in corresponding obligations on both sides; towing and towed ship suppliers.

The study recommends that it would have been desirable if the legislator provides for the towage as obligatory, and at the same time suspends the national ships in order to monopolize the towage income that increases the public resources of the country
